Here is a breakdown of a Full Service California Divorce No Children OR Assets and Debts

Step 1 – First, I will prepare your initial divorce documents for your divorce. These are the necessary forms that the court needs to open or start your divorce case. It is what the divorce court needs to issue a case number. The reason to do this as a first step is so that we can quickly have your divorce started so I can then serve your spouse.

Step 2 – Second, I will prepare your preliminary declaration of disclosure also known as PDD’s.  This is a series of 4 forms and worksheets designed to declare your assets and debts and income and expenses.  Even though this service is for “no assets or debts” the disclosure process is still mandatory.

Step 3 – Third, I will prepare your judgment. There are alot of forms. This is where all the agreements are documented. While you may not have any assets or debts, there may be other issues or agreements you want to address.

Step 4 – Finally, once all documents are drafted and all parties have signed all the divorce papers, I will prepare your documents for final review to the court. Once I submit the final documents to the court the court is taking approximately 90 days to review and approve the final divorce papers.

Now, because there are no assets or debts or children involved, and the agreements are very minor i have been known to complete the entire divorce case in a single meeting. This usually take about 2 hours to prepare all the divorce forms in a single meeting. This is workable if both parties are in total agreement. For a full service California divorce with no children or assets or debts its currently being offered at a discounted package price of $499

PATERNITY

Yes, I handle Paternity filings… First, what is Paternity and why is it important to establish? First, to “establish paternity” means to establish the father of the child This is important because until the father is established as the father, he technically has no custodial or visitation rights. But why would you have to do that if the father is on the birth certificate? Good question. Not to get too technical on you, but when one is married, the children of the parents are “presumed” to be theirs simply because they are married. But when you are not married, there is no “presumption” of who the father is and why you have to establish this through the eyes of the court. This does not mean the father of the child is being challenged. You don’t have to get a DNA test to be established as the father of the child. To establish paternity is a court process where a petition for paternity can be filed by either the mother or father and can be uncontested or contested if you feel your not the father, but generally both parties are in agreement to who the father is only custody, visitation and child support are issues that would need to be agreed upon or determined through a paternity hearing. I can help you get through the paternity process by taking care of everything from paperwork to court filings to finalizing your paternity case.

PROCESS SERVER

Service Rates And Mileage

Routine services, meaning the first service attempt is within a week after receipt of papers, varies depending on the type of case and region. Typically rates are $100 same day service, 2-3 days are $80 and within the week $70, .40cents per mile.

If the service is a “rush” service, meaning the papers must be served that day, the rates increase. Corporate Services: I have no problem going to any organization over and over until the job is done. Process servers sometimes call these “drop” services because the papers are “dropped off.” The charges for these services are typically less than for routine process services. If I am making multiple stops to the same agent I can give you a reduced bulk rate. Diffucult Services sometimes the person that needs to be served legal papers actively dodges the process server by, for example, not answering her door, having family members claim he doesn’t live at that address or other avoidance tactics. Process servers often call these “difficult” services. Due to the additional effort, investigative techniques and time required to serve the person, the process server charges more. These additional rates are negotiated between the process server and client, and usually reflect private investigation rates for the region.

Additional Costs : Although the routine service rate typically includes the cost of a notary, some process servers charge separately for that service — an average cost for a notary is $10 to $25. If a client is unsure where the person to be served lives I will skip trace (locate) the person for an additional flat fee of $199. I will also file the proof of service at the court for an additional fee.

NOTARY

A notarized letter is a valid document that has been verified as authentic by a notary — an impartial, official witness or place of business such as a bank or credit union. Notarized letters are important in legal matters as proof of the validity of documents and information, to help with evidence or case building. You can get a letter notarized in many locations around the country, and it does not require extensive legal knowledge or support to accomplish this.
